Time card manipulation

My company for a few years manipulated my time card in order to not pay an off shift bonus which continued until now.

I’ll try to keep it short. Originally, the company and 1 individual agreed on a sort of split shift that ran until 1 am. They needed another person to work the shift for safety reasons and per the handbook.

The time card access was new to us at this point. And a couple years later I realized on it they had me clocking out in the system the entire time at 11:59 instead of 1 am when I left. I didn’t think much of it.

Forward a couple more years and it was evident what was going on. The shift had also become incredibly important to meet weekly goals as well.

Long term it turned into a fight just to get off this shift, our leader ignored us. Including emails calling out what was going on.

What proved the manipulation point was my coworker did a shift swap and when he came back they corrected his time card to leaving at the correct time, 1 am. And he began to receive the pay differential.

Finally got HR involved, took months but they Seemed receptive. In the end they offered to back pay up to where the other individual began to receive the differential. They said because I took the shift not knowing of the differential that it wasn’t required to be paid…seems off.

But to me they or the person who set it up, manipulated the time card willfully in order to not trigger the 10% bonus, then the current people in charged pushed back on me and ignored me for years. The 2nd part is my bigger concern because per our handbook you can only do these things 16 weeks and I was ready to go back to my shift.

Our handbook has specific rules about working off shifts and receiving the off shift differential, but my shift was more split, close to a 2nd shift type hours(but later). the time card system is what wanted to trigger the differential.

The total wages owed would be north of 50k, if they do in fact owe. It’s a major company btw
