I received a notice about pest control coming to my apartment to preform routine spray with a timeframe of 3 days. I work an overnight and usually go to bed before noon. He showed up around 12:30 on the last day after I had already layed down to go to sleep. I hear him knock, and I quickly get up, get dressed, and run over to the door. As I approach the door I see it jiggle and I open it and immediately ask him not to enter the apartment without me answering the door first. I explain we are home every day because of our work schedule, and sleep during the day. We have cats so we leave our bedroom door open and usually sleep naked so I’m not comfortable with him entering, but will always be home to answer the door if he will give me a moment to get out of bed and get the kitties put away
He writes it down and explains to me that they didn’t provide him with a key, which is good, and he will knock good and loud for me next time. He also informed me that he could come by the next day instead and write that my animals were not put away so I could go to bed. So he really didn’t need to try and enter.
My lease says only management can enter without consent only in a case of an emergency. 3rd party will not receive a key. I’ll receive a notice about pest control but says nothing about if they can enter on their own.
Cut to about a week later, and we get another notice about pest control stopping by AGAIN. It says he will be stopping by on the 18th sometime between 9am and 1pm. My days are always messed up bc of my schedule and I forgot it was the day he was coming. I lay down around 12 and I’m nodding off at 1pm. At 1:10 I hear “pest control!” very faintly, I think it’s coming from outside my door. I LEAP out of bed and start running to the living to let him know we need a second to get prepared, and he is already standing in my living room and I have run in there completely naked-
He just says “they gave me a key” and I run away. I was half awake, with our previous conversation I was not expecting this man to enter my apartment without my consent. Is this on me? Is there anything I can do about it or do I just have to live with this for the rest of my life.
