My wife and I moved into our apartments in July. On July 29th our apartments complex was bought by new management and the portal to pay the rent was closed. Our rent itself is covered by a sign on agreement that said we don't pay rent for August. However there are still the utilities through them that add up to 150 dollars.
On the 29th we had posted on all our doors a notice that said "We are currently awaiting final information from -redacted- while our new online payment portals are being activated. In the meantime‚ please note the following:
Lease terms: Rent amounts remain exactly as stated in your current lease agreement.
August Rent Flexibility: Rest assured that we will work with you on payments for the month of August.
Late fees: NO LATE FEES OR PENALTIES will be charged for August rent while we finalize the portal setup."
Now today as we were walking out to go to work this evening‚ we have a paper saying that our rent payments are outstanding and we have until tomorrow at noon to pay our balance in then our account will be processed for eviction at 3.
We don't have the money until our next paycheck to pay the remainder. Since we are required to pay with a check for now‚ we haven't been notified of the new portal being up‚ we planned to pay our rent for next month a day early with the 150 added on. Are they able to evict us for paying later but still within the month? That sure sounds like a late penalty to me.
