Background information: Hi, I am the mom of a 3 year old boy. My ex and I have joint custody, but I am custodial. My ex has him 3 days a week.
Our child is never with anyone but me during my parenting time, but my ex often fails to follow the order that states he must ask me before getting a babysitter, and he consistently has strange women in and out during his parenting time. I’m unable to receive actual legal assistance, I recently consulted with legal aid and they didn’t have capacity.
While putting my child to bed tonight, he put his hand on my vagina and stated “I make you so wet”. As soon as he fell asleep, I broke down. I have been in an insane state of shock, and I do not know the exact steps I need to take. I can’t even think or wrap my head around anything.
The TV my son watches at home is age appropriate, I am always with him when he’s home, something is happening or he’s viewing inappropriate content when he’s with his other parent. Ex’s parenting time starts Thursday.
I don’t know if my word is enough to not allow our son to return, so I have screenshots from my ex to his recent former partner admitting to sleeping while our child is awake alone. The messages show that he was irritated our son kept waking him up (for basic needs), and our child ultimately soiled himself because of the lack of assistance (he stated that he heard our son saying he has to go potty, but was too groggy to react), and he has slept 30m, 1hr, 2hrs past exchange time while he has our son which makes me reasonably worry that our son is also awake alone.
Should I file for emergency custody? Does this warrant that? Should I give the information about our son also being “neglected” and the screenshots? I’m so lost and confused on what to do, where I stand, next steps.
