My 12 year old daughter and 13 year old son live primarily with me in California. They have summers, springs, and every other Christmas/ thanksgiving in Washington state with him. We separated about 10 years ago, there was domestic violence and a no contact order. The last 10 years he’s made coparenting and dropoff/pickups absolute hell. He owes $8,600 years n child support plus thousands in medical and ortho. He’s a textbook narcissist and emotionally manipulates my kids in ways that’s really hard to explain in a single post. Some things recently came to light and his ex reached out to me because she currently has 2 no contact orders against him in 2 counties and he has multiple upcoming charges and cases in 3 counties.
Apparently my kids have known this was going on since last spring break. They even were driving around in their grandpas car because their dad had a warrant and didn’t want to get arrested driving in his own car. He told the kids to keep this from me and that he could be going to jail. I asked my kids about the charges and they reluctantly started telling me things. My daughter was coerced to repeatedly call and text the protected person during the no contact time.
I am planing to file emergency temporary orders and have a paralegal working on it. I want no physical contact (he’s supposed to get them for thanksgiving!) and requested supervised (by me) FaceTimes because I’m not sure they will grant me complete no contact. My daughter doesn’t want to talk to him at all. He keeps calling and texting her and now he’s telling me that I’m keeping him from his right to FaceTime them (in our parenting plan from 2018 it says he gets video calls on the days and Friday) I’m not sure what I can or can’t legally do right now. Do I have to force her to call him? My son would call him but he’s feeling uneasy about the whole thing and I feel like his dad is manipulating him and just trying to get sympathy for the charges that he 100% deserves. These charges include, stalking, harassment, domestic violence, reckless driving and telephone harassment.
Until what I file is ordered on by a judge does she have the right to refuse this contact? My parenting plan was finalized in Washington but I have since had it moved to California. He still resides in Washington.
