Labcorp Employee Snooped - Still has job.

I don’t know if I need a lawyer, but I feel like maybe I do. A little over a year ago I told my husband’s ex wife, a Labcorp employee, that my daughter (15f) no longer had cancer. Her response, in the middle of a very crowded football game stated, ”I knew three days ago, I checked her records.”

She didn’t learn anything from her records because my daughter got her all clear through imaging, however, I was still appalled.

I reached out to Labcorp over the course of months and they finally admitted that she did look at her records, however, it was not a hipaa violation because she didn’t disclose the information to anyone, although, in my mind, she disclosed it to herself, me, and anyone who heard her at the game.

After they didn’t do anything, I asked for access records for both my daughter and myself. It took a YEAR. When I finally got the records I learned that she not only snooped on my daughter’s records, but MINE AS WELL.

The lab she works at is a Labcorp affiliate, so at this point I reached out to the foundation that runs the lab to let them know what she did and ask that since she was allowed to keep her job, that they at least ensure she has no access to my or my family’s records.

It’s been a month and I haven’t heard anything.

The craziest part about this is that every time
I have bloodwork done, I worry about this person. It should not be like that and I feel like I have case but I don’t know because lab corp blew it off so hard a year ago.

Edit: I did file a complaint with OCR, but they closed the complaint without investigating. They did not give me a reason.

It’s really confusing because Labcorp admitted to the snooping and provided proof, but did nothing.

It feels like I have a case, but do I?
