Location: I work in Illinois. I am visibly disabled and walk with a cane, I have a brain malformation and a heart condition. My boss was made aware that I have medical conditions that may cause me to faint, she said she would provide accommodations accordingly and if I were to have an episode, I’d sit or lay down in the back room safely. A week ago, I had a medical episode about 45 minutes before the end of my shift. I started to lose control of my body and I became very disoriented and sick very quickly, so I sat down. I couldn’t stop fainting, I couldn’t stand and I was having brief episodes of convulsions, so she sent me home. I thought this was kindness on her end, but I got a phone call the next morning that, while she “personally believed that I just had a panic attack”, that I would not be allowed to return back to work without a doctors note. I went to my cardiologist, provided her a doctors note explaining that while I am able to work, I just need accommodations when this happens.
I have been fired. Despite all her compliments, being built up and told I work harder than the other assistants despite being disabled, despite arriving early, staying late every day, I have been fired because she believes I am no longer reliable or capable of working for her.
Is this legal? If not, I don’t know if I would even fight it. I guess I just would love to hear some outside opinions.
