Divorce

Location: California

I read the rules and I don't think that this is inappropriate but I'm so sorry if it is.

I (31F) live in Southern California (Ventura County to be exact) and have been married to my husband (31M) for about a year and a half - embarrassing I know. I have an 8 year old from a previous relationship and we have a 10 month old together (EMBARRASSING - I KNOW). I make appx 60k a year and he makes appx 120k.

I can not afford to live in this area on my own. I'd have to move about an hour away (with no traffic) and I should be able to make it work. I have zero family in the state and my older child is with me 100% of the time because his father passed away. My husband lives in the town he was raised in and his parents are down the street - both retired. He owns a home here so this is where he will stay.

My question is, will he likely get 50/50 custody with me? The baby is so young right now but there would have to be a decision made at some point about where her primary residence is for school. I work from home and can have very flexible hours and I don't use childcare. My husband works 60+ hours a week and leaves for work at 4:30 am and often doesn't get back until at least 5 pm but it could be much later - he has to stay at work until the work is done and sometimes that means up to 20-hour shifts with very little flexibility. Is it reasonable to assume that I will be able to get an agreement where I have the baby Monday - Friday at least? Legal custody being 50/50 is fine but I don't know if I want to move forward with this if it would be week on/week off and the baby would spend all of her waking hours with his parents while I'm an hour away without her.
