My 82 year old mother who has lived in the house over 50 years was notified by her neighbor of 5 years that they had a survey done and the boundary wall is 3 feet inside their property. They are telling her she has to pay to remove the wall and lose 3 feet of her property. On the same day they ripped out 3 feet of her landscaping in the portion of dispute without a wall before even talking to her.
The wall has not been replaced in the over 50 years she has lived there and is likely the original property wall from the 1940s when the subdivision occurred. This neighboring property was owned by the original owners when she purchased the house (who were there for 20 years after she moved in). This neighboring property has changed hands twice in those 50 years with no questions about boundary lines. These are 5000sq foot properties so it’s not like the wall position isn’t obvious to everyone, looking at property maps it doesn’t seem possible that the wall would be 3 feet in the wrong location, but none of us are surveyors.
I guess she’s going to have to pay 💰 💰for her own survey and a lawyer, but this is crazy, right?
