Location: Putnam County NY
For more context: I live in a condominium in NYS and each unit is assigned a parking spot, one spot per unit. There are a few "x" spots in each lot for visitors but they are primarily used by those who own more than one vehicle.
I have a unit owner who has a car that she won't get rid of because it was her father's (who passed away about 10 years ago) and she had it in an "x" spot for quite a while and wouldn't move it, meanwhile her other working vehicle would be parked her assigned spot. Parking is scarce and the condo board told her she must move her vehicle. So now it's been parked in the assigned spot and she parks her working car in an "x" spot. The vehicle in question now has expired registration and inspection stickers (2025) and three flat tires. And she throws a hissy fit if someone is parked in an "x" spot when she gets home from work and then she parks illegally in the fire zone.
The condo board says they can't tow it because it is on private property, which I get but I think they don't want to be bothered with paperwork and having to deal with her.
Everyone is getting fed up with the loss of a parking spot. Does the board have any recourse in notifying her that the vehicle would be considered abandoned since it literally hasn't moved since June of 2025, expired registration/inspection, three flat tires, yellow jackets are in the trunk, and just sitting there also preventing proper snow removal during the winter months?
I would like to go to my board with some sort of solution, but I was wondering what legal moves need to be taken to get that thing towed. It does still have plates affixed to it. Thank you!
