Eight years ago, I notarized a warranty deed. The plaintiff filed a claim against my notary bond, saying I had not explained the document to him. After the bond company told him I had done nothing wrong, he sued me, claiming he was not present for the notarization.
I kept all my notary journals and found his entry. I even recorded his Texas driver’s license number. The bank where I work provided an attorney, who told me I should be able to get the case dismissed, but the judge denied the motion to dismiss.
I’m worried now. Does my notary journal count for anything, especially when he stated in court documents that the document was not explained to him?
