Bank of America stole my money

On Jan 16, right after my paycheck arrived, I discovered that both my Bank of America accounts (credit and checking) were closed without any prior notice. After I called them, they refused to explain why this happened, but they promised to send me a refund check for all my remaining funds (slightly less than $10k). They asked for my mailing address, and apparently someone heard it incorrectly (I don’t understand why they still do this over the phone). As a result, all my money was sent elsewhere.

It’s been more than a month. I can’t pay my medical bills, and I can’t afford my medication (not life-threatening, but still). I was penalized by my landlord because I wasn’t able to pay rent. I had to live off a giant bag of rice that happened to be in my cupboard for almost two weeks, and even after that, almost all my salary immediately went to covering bills and necessities.

I’ve talked to them about 10 times. They "fixed" my address in their system, but they said they can’t reissue the check and can’t do a direct deposit. They claim there are no other options and that I have to wait 120 days until the check expires. In 120 days, my visa will be over and I will no longer be able to stay in the US.

What are my options? A lawyer said I need to file some kind of complaint, but I’m really desperate to get my money back.
