Hello all, I recently moved out of an apartment and I got a check for my remaining rent and security deposit refund. I deposited the check this past Saturday. I got some money then, transferred it to my boyfriend (his half), and then received the remaining balance today. I spent some of the money, paid bills, got lunch etc. then around 5pm I got a notification that my account was over drafted by about $500. I called the bank and they said that they don’t have access to the details currently since the return is pending, but most likely what happened was the check from the apartment company bounced. I plan on calling the company tomorrow to get a new check issued but I want to know what my rights are as a tenant because now technically the 30 days they have to issue my check after move out has passed, their check bounced for some reason, and I don’t want to start getting overdraft fees for my bank for an issue that is not my fault.
